Antidumping and Countervailing

Antidumping Duties and Countervailing Duties

Antidumping (AD) and countervailing (CV) duty law is extremely complex, and, unfortunately, these laws and regulations change often. But the experienced customs lawyers at Peter S. Herrick can assist you in all antidumping duty and countervailing duty cases. We’ve represented numerous companies in antidumping duty and countervailing duty proceedings, investigations, and more.

AD and CV duties are additional fees imposed on importers or exporters to guarantee a level playing field between U.S. and foreign manufacturers or suppliers.

Antidumping Duties

If determined that a foreign manufacturer or supplier is selling goods in the U.S. that undercut the current fair market value of the product, an AD duty can be assessed against the foreign company.

Countervailing Duties

If a foreign government were to provide assistance to a U.S. company that gives the company the ability to export goods at under the current fair market value, a CV duty can be assessed that is based on the value of the assistance provided by the foreign company.
